Equipment Lease Agreement

THIS EQUIPMENT LEASE AGREEMENT (the "Agreement") is made and entered into this [Day] day of [Month], [Year], by and between:

1. Equipment Description

The Lessor hereby leases to the Lessee, and the Lessee hereby leases from the Lessor, the following equipment (hereinafter referred to as the "Equipment"):

2. Lease Term

3. Payment Terms

• Monthly Rental Rate: The Lessee agrees to pay the Lessor a monthly rental fee of [Insert Amount] (e.g., $50.00).

• The Lessee shall not alter, modify, or attach any unauthorized hardware to the Equipment. No illegal or pirated software may be downloaded or installed.

5. Maintenance and Repairs

• Lessor Responsibilities: The Lessor warrants that the Equipment is in good working order at the commencement of the Lease Term. The Lessor shall be responsible for routine hardware failures not caused by the Lessee's negligence.
• Lessee Responsibilities: The Lessee shall keep the Equipment in good repair and appearance. The Lessee is responsible for the cost of repairs resulting from negligence, misuse, spills, drops, or intentional damage.

6. Loss or Damage

The Lessee assumes and shall bear the entire risk of loss, theft, destruction, or damage to the Equipment from any cause whatsoever. In the event of loss or complete destruction, the Lessee agrees to pay the Lessor the fair market replacement value of the Equipment, assessed at [Insert Agreed Value, e.g., $800.00], minus any depreciation.

7. Ownership and Assignment

• The Equipment is, and shall at all times remain, the sole and exclusive property of the Lessor. The Lessee shall have no right, title, or interest therein except as expressly set forth in this Agreement.
• The Lessee shall not assign, sublet, or transfer this Agreement or the Equipment without the prior written consent of the Lessor.

8. Default and Termination

If the Lessee fails to pay any rent when due or breaches any other provision of this Agreement, the Lessor shall have the right to terminate this Agreement instantly upon written notice. Upon termination, the Lessee must immediately return the Equipment to the Lessor.

9. Return of Equipment

At the end of the Lease Term or upon termination, the Lessee shall return the Equipment to the Lessor at the Lessor's address at the Lessee's expense. The Equipment must be in the same condition as when received, excepting reasonable wear and tear, and all personal data must be wiped by the Lessee prior to return.

10. Governing Law

This Agreement shall be construed in accordance with and governed by the laws of the jurisdiction of [Insert State/Province/Country].
